AccessMyRecords.comSM (hereinafter referred to as "AMR") is a privately held Corporation in Boca Raton, FL.
By becoming a member of AMR and by using the AMR website, you agree to the Terms and Conditions of Use set forth by AccessMyRecords.comSM . If you do not agree to the Terms and Conditions of Use, you may not become a member and may not use the website.
AMR may from time to time, revise these Terms and Conditions by updating this document on the website. You should continue to review these Terms and Conditions as they are binding on each member as revised. Terms and Conditions last updated on August 15, 2011
The AMR membership program is a service which supports members in being proactive in their healthcare. The term of your membership is for one (1) year (365 days) from the date of joining. The membership entitles you to have your own database on the website with a User Name and Password of your choice. A unique AccessIDSM Code is generated by the website. Should the need arise, this AccessIDSM Code and your name enables emergency personnel to access a designated website page containing health and legal information pertaining to that member. The member has selected the information to be viewed on that page. This website page is called the Emergency Medical Records. This page cannot be altered by anyone other than the member.
You warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement or you have obtained the consent of anyone else whose personal information is to be stored on the members account from AMR website and to access the account and be responsible and ensure that any access or use by them complies with this agreement.
The membership includes a wallet-sized AccessIDSM Card, Key Tag and Window Decals, which contains information in order the access records from the AMR website. The membership also includes areas where the member may enter and track specific health data. Various reports may be generated by the member showing the health history.
The information contained in these pages is NOT to be used for diagnosis or treatment and is NOT intended as a substitute for professional medical advice or the care patients receive from their physician. This website and the AccessIDSM Card do not replace scheduling regular visits with your primary care physician YOUR HEALTHCARE IS YOUR RESPONSIBILITY.

AMR accepts data from members via the website, fax, mail, email or telephone. AMR will enter or upload information for a member but it is still the responsibility of the member to make sure the information is entered correctly. All data that is entered into the member’s database is contained in the member’s account, which may be viewed and printed through the Emergency Medical Records Report.
The information that you decide to enter and maintain on the AMR website is your information. You decide with whom to share such information.
By becoming a member of AMR, you have agreed that in the case of an emergency, you authorize AMR to release all medical and other confidential information about you to emergency personnel who have your permission to review the information in your Emergency Medical Records by logging into the AMR website using your AccessIDSM Code and Name or from a Smartphone using the AMR ICE (In case of Emergency program). Once logged in, they may view and/or print your records or your records can be obtained by calling customer service at 800-796-6431.
You may print copies of your Personal Records Report to share with your doctor or anyone you choose. Emergency personnel only have access to your Emergency Medical Records which they cannot alter and do not have access to the password protected section of your account.
It is each member’s RESPONSIBILITY to enter and confirm the personal information that has been added to the member’s account on the website database, to keep their data current, accurate and complete. To use the AMR website only for the storage of your own and other family member’s health information and other documents as permitted by AMR.
To take reasonable care not to introduce any virus, worms or other computer code on to the website that could manifest, contaminate or have destructive properties.
Not to send AMR any original documents to be uploaded and to ensure that all handwritten information is to be clearly legible. Each time you or AMR or its contractors upload and post information to the website whether belonging to you or to others you represent and warrant that you own or otherwise control the rights to the information or that you have the necessary consents to upload or have uploaded said information that it is accurate and complete. It is up to the member to review all information that has been added to or uploaded to their account by themselves or by an AMR staff or contractor to insure that the information is true to fact and up to date
Should any information in your account on the database be inaccurate or incomplete, you are SOLELY responsible for any consequences that may occur. This includes, but is not limited to, adverse reactions from drugs, prescriptions, treatments, surgeries and fatalities, incorrect doctors or personal contacts information including health insurance carriers.
If you check YES as an Organ Donor and have listed the Organs and Tissues you wish to donate. It is the responsibility of the member to have a signed donor registration form on file. AMR recommends keeping a copy of that form in the legal section of your account.
The term of your membership is for one (1) year (365 days) from the date of joining. You must re-new your membership in a timely manner, or it will expire. AMR will send a reminder notice via electronic mail or standard mail if you do not have a email address before your membership expires. Your membership will automatically renew if we do not here from the member before the members expiration date. It is each member’s responsibility, and/or that of their representative, to insure that AMR has a current and active e-mail address for their membership account. You may update your e-mail address on the My Personal Information page. A new AccessIDSM Card, Key Tag and Window Decals will be mailed to you upon renewing your membership.
Should your AMR be lost, misplaced or worn out, it is the member’s responsibility to contact AMR, by phone or electronic mail, and provide notice. A replacement card will be mailed to you at no additional fee.
AMR is not responsible in any way, for any unauthorized entry to your website database account, or responsible for any consequence of your personal data being viewed or printed by someone who gained authorized or unauthorized access to your personal account.
AMR is certified with GeoTrust a VeriSign Company and all records are transmitted securely utilizing QuickSSL the latest 128-bit technology offering the highest level of encryption security possible.
According to the Office of Civil Rights, AMR is not defined as a “Covered Entity” and is not bound by HIPAA guidelines for privacy compliance. You acknowledge having read and understanding the Privacy section on the website.
AMR’s staff or contractors who may assist you to upload your information into your account or who may provide your information to those requesting it have signed a blanket privacy and confidentiality agreement with AMR or the contractor. AMR does not guarantee that there will be no misuse of your confidential information by anyone working for AMR as a contractor or employee; and will not be responsible for the loss or damage arising from any disclosure or misuse.
AMR and its staff or contractors will not be responsible for any release of information to unauthorized persons provided they acted in good faith.
AMR may block uploads or posting to its website if it feel necessary in order to protect themselves and its members.
AMR will use today’s technology to provide an uninterrupted and error free service to its members yet its suppliers may not have control. AMR and its suppliers assume no responsibility for, or relating to, the interruption, failure, loss, damage, delay or corruption of any data that is transmitted in uploading or posting to, or from, the AMR website.
At any time, AMR may terminate your membership for violation of any of these terms. You, at anytime, may discontinue your membership with AMR. You may receive a full refund if you terminate your membership within two weeks of first joining the AMR service; otherwise there is no prorating of or any refund of any fee if the membership is terminated or wishes to be terminated before the expiration date. Upon receiving written request, by either electronic mail or US mail, stating that you wish to terminate your membership, AMR will block access to your data within five days of your written request to terminate. Your data will be kept in the AMR database for one year from termination incase the member wishes to reactivate the account.
Should your membership lapse, unless AMR receives written notification to the contrary, your database account will remain open and will be available for Emergency personal to gain access for 30 days following expiration of your membership.
Notwithstanding anything else contained in this agreement, to the extent permitted by law, AMR liability for losses or damages will not exceed the amount of one year’s subscription.
All other damages, direct or indirect, special, incidental, consequential or punitive, including but not limited to, lost profits or damages resulting from lost of data or business interruption arising from any use of or inability to use any content or other parts of the website, are hereby excluded even if AMR had been advised of the possibility of such damages.
THIS WOULD INCLUDE WITHOUT LIMITATION, REASONABLE LEGAL AND ACCOUNTING FEES RESULTING FROM, OR ALLEGED TO RESULT FROM, YOUR USE OF THE MEMBERSHIP AND/OR THE WEBSITE, IN A MANNER THAT VIOLATES, OR IS ALLEGED TO VIOLATE, THESE TERMS AND CONDITIONS OF USE, OR FROM YOUR LACK OF RESPONSIBILITY IN INSURING YOUR DATA IS ACCURATE AND COMPLETE. ACCESS MY RECORDS.COM AND ITS SUPPLIERS ARE NOT LIABLE FOR ANY PERSONAL INJURY, INCLUDING DEATH, WHICH MAY RESULT BY YOUR USE, OR MISUSE, OF THE WEBSITE OR ITS CONTENTS AND BY THE USE OF YOUR AccessIDSM CARD.
AMR NOR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, REPRESENTATIVES, OR AGENTS MAKE ANY REPRESENTATION OR WARRANTIES AS TO THE ACCURACY OR COMPLETENESS OF ANY OF THE INFORMATION CONTAINED HEREIN, INCLUDING, WITHOUT LIMITATION, ANY MEDICAL HISTORY INFORMATION, AND ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, REPRESENTATIVES, AGENTS SHALL NOT HAVE ANY LIABILITY TO YOU OR ANY THIRD PARTY AS A RESULT OF YOUR USE OF SUCH INFORMATION.

THE TERMS AND CONDITIONS OF AMR AND EACH RELATED AGREEMENT SHALL BE CONSTRUED AND ENFORCED IN ACCORDANCE WITH THE LAWS OF THE STATE OF FLORIDA AND YOU HEREBY CONSENT TO JURISDICTION IN THE STATE OF FLORIDA. VENUE FOR ANY ACTION INSTITUTED WITH RESPECT TO AMR OR ANY RELATED AGREEMENTS OR THE TRANSACTIONS HEREUNDER SHALL LIE EXCLUSIVELY IN PALM BEACH COUNTY, FLORIDA.

These Terms and Agreement of Use constitute the entire agreement between you and AccessMyRecords.comSM with regard to the AMR service and the website and you acknowledge that you are not relying on any representations made by or on behalf of AMR in entering into this agreement.
AMR may assign its rights and obligations under this agreement to a third party at any time without notice. Commencing immediately upon such assignment, AMR will be relieved of any further obligation under this agreement.
